Terms & Conditions

Requirements: Renters must be 25 years of age or older. We can only accept reservations with arrivals up to 12 months in advance. We require a 3-night minimum stay. During the time period of Thanksgiving and Xmas, New Years we require a 4-night minimum

Reservation Holds: Due to the high demand of certain weeks and timeframes, we are not able to hold any reservations. We do recommend that once you have decided on a rental property and time frame that you book right away to avoid missing out on those dates.

Website Reservations: A credit card is required to make all reservations. Website reservations are subject to all terms and policies.

Rates, Taxes & Fees: Published rates are weekly rates, and reflect payment by Visa, MasterCard, Discover, and American Express credit cards. All rental rates are subject to change without notice. Tax is included in the total price and is 19% (16% state/ 3% local).

 

Property Damage Protection (PDP) deposit of $500.00 USD. PDP deposit, processed by credit card, 5-7 days prior to arrival. Guest credit card held open until inspection of property at time of departure fully refundable (less a $30 processing fee) within 5-7 business days after Guest’s Departure Date less deductions for any damage done to the said property Salina del Mar, any missing items that need replacement, any excessive cleaning required, any fees charged for extra number of occupants not specified as Authorized Guests, and any other extraordinary expenses or deductions that may have been incurred during the period of Guest’s Occupancy Dates including any foreign currency exchange fees. Guest agrees to promptly pay for any cost(s) of repair or replacement which may exceed the amount of the Security Deposit.

RATE CHANGES – Rates subject to change without notice before agreement signatures.  

FALSIFIED RESERVATIONS – Any reservations obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.

WRITTEN EXCEPTIONS – Any exceptions to the above-mentioned policies must be approved in writing in advance.

FIRE RING – The fire rings are propane, please, adults only light with caution.  Please do not throw any paper or other combustible materials in the fire rings.    

POOL HEATING - Diving or jumping is not allowed from balconies or terraces.  Pool water temperature is set at 84 to 86 degrees. Request for water temperature above 86 degrees will result in additional fuel surcharge fees.

WATER AND SEPTIC – These villas are on septic systems.  The mineral content in the water is high.   The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT send coffee grinds, grease, or feminine products down the sinks or toilets.  DO NOT FLUSH anything other than toilet paper.  No feminine products should be flushed at any time.  If it is found that feminine products have been flushed and clog the septic system, you could be charged damages of up to Five hundred dollars ($500)

Utilities: No compensation will be given for temporary outage of electricity, gas, water, cable, satellite, or telephone service. Utility service outages should be reported immediately, and all efforts will be made to have them restored as soon as possible.  

CONDITION AND USE OF PROPERTY-The Property is provided in “as is” condition. Rental Agent/Manager shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access or hot tubs, fireplaces as applicable. Rental Agent/Manager shall not be held responsible for such item’s failure to work however, will make every effort to correct any issues as reported as quickly as possible. Guest acknowledges that use of amenities such as pools, spas, fireplaces, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the

Guest’s own risk. Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbors, nor shall Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

Amenities are NOT guaranteed - There are NO REFUNDS for the malfunction of any equipment including but not limited to air conditioning, TV, pool, appliances, power outages and cell phone service.  Every effort has been made to ensure all equipment is in working order.  Please report any inoperative equipment to the caretaker. Owner, agent, housekeeping and /or subcontractors may enter premises during reasonable hours to perform maintenance.

No refunds due to early departure - This includes departures due to inclement weather, illness, bug bites or any other reason. While we do our absolute best to ensure that our villa is in a clean, comfortable, well maintained condition, we are not responsible for any unsightliness due to ongoing maintenance and repairs or any kind of insect that a guest may find in, on or around the villa. All guests are financially responsible for the entire booking once your reservation has been made.

GENERAL STATEMENT - All information contained herein is considered to be accurate and truthful. THE VILLA OWNERS and caretakers or housekeeping assume no responsibility and shall have no liability whatsoever for errors, including without limitations, typographical errors and or omissions. Furnishings, and amenities are subject to change without notice. In the event villa is unavailable for rental due to fire or storm damage we will do everything possible to find you alternate accommodations. The renter fully understands that: the villa owners and caretakers/housekeeping is not responsible or liable to renter for loss or theft of any of the renter's personal property, accidents, injury or damage of any nature from any cause to renter (including guests, licenses, or invitees) or acts of God, weather, road, travel or diving conditions or other recreational activities, or items removed or changed in the villa. Guest(s) hereby agree(s) to INDEMNIFY and hold the villa owners and caretakers/housekeeping harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises or the items of personal property provided therein. Guest (s) assumes the risk of injury or other losses relating to any recreational activities and will hold home owner and its agents harmless with respect there to.

DEFAULT- If Guest should fail to comply with the conditions and obligations of this Agreement, Guest shall surrender the Property, remove all Guest’s property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

ASSIGNMENT OR SUBLEASE-Guest shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or guests of the

Guest and included within the number of and as permitted occupants under this Agreement.

  

NATURAL DISASTER POLICY, STORM POLICY– Refunds are only given through CSA Travel Protection Insurance. http://www.csatravelprotection.com/ CSA Travel Protection Insurance must be purchased before the storm has a given name for Hurricanes or Tropical Storm.

No refunds will be made by Rental Agent/Manager or owners due to Natural Disaster, Hurricanes, or Tropical Storms, even in the event of mandatory evacuations. Refunds are only given through CSA Travel Protection Insurance. http://www.csatravelprotection.com/Travel Guard travel insurance is also available to provide coverage for your reservation. In the event of a natural disaster-hurricane-tropical storm in the customer’s final destination which prevents travel, customer will have the option to re-schedule travel dates for use within one year of the original travel dates at the same property. Should a natural disaster occur while the customer is in their final destination causing the customer to depart early, they may reschedule the unused portion of their reservation within one year of the original travel dates at the same property. Rescheduled reservations are subject to current rates for the dates selected at the time the reservations is requested. 

TRAVEL INSURANCE    We highly recommend all guests purchase travel insurance.  If you wish to purchase travel insurance, go to www.InsureMyTrip.com for details and to purchase. TRAVEL INSURANCE/ Personal Articles Policy - The rental properties will not ship or mail personal articles due to foreign exportation and USA importation laws.

The Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guests. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
